Hi Gordon,
Waht sort of instances does this happen and is it often, is it at the beginning of the hearing that they decide this and then postpone the hearing?

It's unusual but not rare. It's most likely to happen at the beginning of a hearing but can happen at any time through it if they are unable to reconcile the medical evidence in front of them.

It's unusual but not rare. It's most likely to happen at the beginning of a hearing but can happen at any time through it if they are unable to reconcile the medical evidence in front of them.

Hi Gordon,
My GP has said that if the tribunal request my medical records then she will do a covering letter.
I'm not sure how to approach the tribunal in my email other than to request the medical records. Have you any guidelines please?
I'm not sure if I need to justify this request in order that the judge would give their permission.

First of all make sure that you are happy for the panel to have your notes, remember you don't get to choose what they see, so if there is anything negative in your notes it might not be a good idea.
As to a letter you need to explain why you think it is important that they request your notes, this will undoubtedly revolve around the quality of the evidence already available, submitted by you and produced by the DWP. Secondly is the historical value of the notes as they either establish that you have had your current level of disability for some time or document that your conditions have deteriorated.
So these are your reasons why you think it would be of value for the panel to have your notes available to them when they consider your case.

Hi,
I've got my appeal soon and I I haven't got anyone to come with me, other than someone who will probably make me more stressed and I think they will get stressed with the tribunal experience themselves. Can it go against you if you go on your own?
I will be travelling by taxi due to severe anxiety. They won't send for my medical reports, so my GP will not now do a covering letter of support. I've got no new medical evidence but my welfare has done a submission. So I feel things are stacking against me and I feel pretty frightened about going and I don't want to make things worse for myself if it goes against me coming on my own.
However, I think if I do go on my own, I'm not sure I can go through with it and end up feeling more anxious anyway.
If this person comes with me could they wait outside the hearing and that would still count as my needing someone to attend with me.?
I'm really frightened about going ahead with it, I have attended a tribunal before but I'm that frightened of going and scared of the outcome that I'm not sure if I'm going to pull out.
Please can you help

You could have them go with you to the hearing but not come into the room with you, if that would help.
If you are trying to score points for being unable to go out alone, then attending on your own will not help you argue this, but it of course dependant on your conditions and how they affect you and it may be that using a taxi offers you the security that you need to go out.
If you are thinking of pulling out then contact the TS and switch to a paper hearing at least that way they will look at what you have already sent, if you cancel the appeal, then you have done all the work for nothing.
