DO I HAVE TO PAY BACK ESA, PIP, INDUSTRIAL INJURYS was created by David
I have Two questions i would like a bit of advice on please.
Work accident two years ago, I'm currently receiving ( ESA,PIP, INDUSTRIAL INJURY'S ).
Company have admitted responsibility & i have taken legal action against the company.
Question 1: Do i have to pay all benefits back once i have been compensated for my injury's ?.
Question 2: My wife is in full time employment & also cares for me, is she entitled to claim carers allowance ?.

If the benefits you are receiving are a result of this accident then the DWP will expect to recover at least some of the monies from any award you receive. If you have a solicitor working on the accident claim then they can advise you on this, if you don't then I strongly recommend that you get one. You should also ask about setting up a trust to hold the money it can help with future benefit issues, even if you do not think that you will have them in the near term.
I'm afraid your wife cannot be your carer if she is working full time, there is an earning limit of £110/week.

So do you mean if i get awarded a compensation payment & claim the same benifits because of my accident in the future after my award i will have to pay DWP back that as well as the benefits I'm currently receiving
