PIP TRIBUNAL - DWP PRESIDING OFFICER PRESENT was created by daveb123
Just had my PIP tribunal and, as well as the Judge, Doctor, and Welfare rights members on the court panel, The DWP sent a presiding officer!
I am not sure what the presiding officers actual job is but I can tell you first hand that, they systematically discredited me , throughout my hearing, and spent at least 20 minutes at the end ..... quoting case-law to the judge ...... So much so that the Judge seemed to go along with them, and my appeal for enhanced rate care was dis-allowed.
The hearing felt more like a Crown Court Trial, than an informal Tribunal.
I had strong medical evidence, and was sure that I was going to win the appeal, and on reflection think that should the DWP's Presiding officer not have been present I probably would have!
All the Presiding officer did was pick holes in my claim and state that the criteria's for the points award did not apply in my case, and that their original decision maker was correct in their award of points. backing this up with case-law and previous court, and higher court judgements.
Very disappointed as was on high rate care DLA, and found PIP one of the hardest benefits to claim, and the DWP's Presiding officer tactics ensured another saving for them.

I'm sorry to hear that your appeal was unsuccessful.
You can request a Statement of Reasons from the Judge if you think that might have been an Error of Law.
What is an Error of Law?
Tribunals – Requesting a Statement of Reasons
Or if you can show that your conditions have deteriorated since you the date of the Decision appealed, then you can request that your claim is re-assessed, but be aware that this would be a full review of your claim, new PIP2 and almost certainly a face to face assessment.
