Hello everyone, about 6 months ago I lost my higher rate of mobility as I managed to walk with a stick more than 20 metres along a passage to the interview office without having to stop. It was not taken into consideration that I have muscle spasms (myclonic jerks) which make me stop and my legs can give way as well as my body jerking. Well the Jerks have become worse and I have been given higher dose of medication for this ,((I take 3 different epilepsy tablets for this) I had a knee replacement done 18 mths ago which I have been back to doctors a few times as swelling has not gone down and it is still very painful, a few weeks ago I had to have x-rays on my other knee as I am having trouble walking and real difficulty getting up and about out of my chair, now I have been told that I have problems behind my other knee cap and have to see the specialist that replaced my other knee to see what can be done, my question is should I inform benefits office and do you think this would make any changes to my claim. Thanks in advance John.

I can't tell you not to inform the DWP, but they are usually uninterested in someone reporting a deterioration of their conditions.

First of all, if you report a change then you are going to get reassessed, a new claim form and almost certainly a face to face assessment.

The primary thing you need to consider is whether you can score the extra points required for an increased award, for the Enhanced Mobility you will need to show that you cannot reliably stand and move (walk) more than 20m on the majority of days.

You will also need to show that you have been affected to this extent for at least three months and that there should be a reasonable expectation that will continue to be affected for at least a further nine months.

Lastly, as this would be a full reassessment of you claim, don't forget you also need to protect the points you already have.

If you think that you can show this then write to the DWP office that deals with your claim notifying them of the deterioration and asking to be reassessed.
