on 26/04/17 I received a home visit off a Capita HP regarding my completion of a PIP review form. On the day a gentleman came to see me, my appointment was for 0915hrs and it lasted until 0950hrs. The HP stated that he had been looking at my case for 2 days prior and stated that I can confirm your clearly on the standard rate for care and im going to get that increased to the enhanced rate.
During the assessment he only asked my for an up-to-date prescription list.
He never asked me any other questions about my conditions, didn't ask me to stand up and walk or anything. I stated that 'he would be here all day if he did that and im playing golf at 1)
So, as he left he stated that I would get the increased enhanced rate for daily living, hopefully they will backdate it to the date I was sent the review for which was the 18/12/2016 and my awards will be awarded for 5 years.
Ive received my award letter off DWP and ive been awarded enhanced rate for mobility and standard rate for daily living.
After explaining everything to the DWP on what the HP said and she informed me that I must complain to Capita about the HP, ive done this and they have acknowledged my complaint.
On the 'my desision' page there is a full report on my conditions and what I told the HP, however, this is a complete lie, he didnt ask me anything, Im so shocked at this.
can you please let me know what to do about this?
will it mean that I will have to possibly have another assessment? to be honest I cant go through another one, I suffer from crippling anxiety
Just to point out that last year I went through a Tribunal in the court of law for my ESA benefit and one my appeal, ive been informed that that doesnt count for anything!!

Whilst the assessor has undoubtedly broken the Assessment Providers rules by suggesting what award you would receive, they should make no comment on this as the Decision is made by the DWP, this is not in itself reason to overturn the Decision, this will only happen by your showing that you meet the criteria to score the extra points that you need.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.
