DLA Tribunal for child was created by Greg
Hello , my child's DLA for Juvenile Arthiritis has been rejected , mandatory appeal rejected and now we have received papers to attend a formal appeal. I am so scared do l have to go? What help can l get ? Can someone go for me ? What do l need to do beforehand? Why do they do this?

You can opt for what is called a Paper appeal where the Decision is made on the papers before the Tribunal panel,. but the success rates for this are far lower than for a hearing that is attended.
I'm afraid I don't see how anyone other than a parent can attend the hearing and properly represent the child, you would certainly need the permission of the Judge.
As to what you need to do, you need to present a case that supports your daughter receiving an award. Child DLA is awarded for two connected reasons; the child has care and/or mobility needs due to their conditions and those needs are reasonably in excess of the needs of a healthy child of a similar age.
I would start by having a look at our DLA Appeal resources
www.benefitsandwork.co.uk/help-for-claimants/dla
there are a number of documents that cover appealing a decision.
If you have further questions then please reply to this post and we will do our best to help.
