I been reading some of my paper work to do with my pending appeal. There is a sentence in it saying that mrs .......... get carers allowance if this is the case then she is careering for somebody for more that 35 hours a week, ( we will bring this up with her at hearing) Well yes I do
I have not hidden this I did tell the lady who filled my pips form out that i have to care for my husband, its not a secret we live together it was the social services who said I should get carers for him, we just plod along and if we cant get it done then we change it and so on
surely its ok I cant not help my husband he has got Parkinson and wont want anyone else helping.
Whats the worse they could/ will do ??

You will possibly be asked about this at the tribunal and will need to explain how it is that you are able to care for your husband despite your own problems.
Of course, if you have physical problems and give your husband emotional support, prompting etc (or vice verse) then this will be easy to explain.

This is a recent tactic being used by the WDP to try and suggest that a claimant does not meet the criteria for a PIP award.
Beyond the requirement for 35 hours of care a week there is no definition of what care is required in order to receive the benefit, it could be as simple as being available to offer prompting and encouragement to the claimant to carry out their daily activities.
We don't normally offer specific advice on the forum but this is a case where I will break the rules! Do not respond to this comment by the DWP, you do not need to address it and by doing so you open yourself up to questioning by the appeal panel if they choose to do so, just ignore it and concentrate on showing that you meet the criteria for an award.
