Providing she closed her ESA claim rather than being found Fit for Work, then she can make a new claim for ESA or Universal Credit if applicable.

innjan wrote: Thank you for your reply Gordon . However would she be able to just give up this new job and make a new claim ? My daughter is also dyspraxic and has learning difficulties and to be honest the whole situation is confusing to me ! If she were to just simply not pursue the work no further would she be sanctioned? She is unfit and shouldn’t have taken a job so soon after having been so ill for most part of the year . Her consultant was completely shocked she had chosen to do so .
Providing her GP will issue a new Fit Note then she can claim ESA, it does not penalise a claimant for having to stop work.
