The DWP may think that my husband falls into this category as he transferred from IB to CB Support Group without any income info being sought.
Reading B&W forum it seems that the DWP is currently sending such people an ESA3 for completion.
If an ESA3 arrives, does he/I (as his carer) have to complete it, or can we just return it marked 'don't wish to pursue possible underpayment'? I was working full-time at the time of his IB/ESA transfer and so our income was above the threshold for ESA (IR) top-up. We now have (from small inheritances when close family have died) savings just above the £16K threshold so still won't qualify for top-ups.
Any advice on what to do if the form arrives will be gratefully received.
Also, please do you have a link to the DWP official info on occupational pension disregard for people transferred from IB/ESA if the pension was disregarded under IB (pension dates form mid-90s).
If you were working for 24 hours or more a week then you would not qualify for ESA(IR), I would write a short note explaining your situation and why you are returning the form blank.
