PIP for OCD. Obsessive Compulsive Disorder

Asking advice for someone’s PIP claim. the claimant has OCD - obsessive compulsive disorder, fear of germs and contamination. they can’t wash or dress often enough, never cook, fear germs transferring onto clothes or food. they live on limited packaged snacks. they fear someone helping would contaminate them. they can’t do the activities it causes anxiety makes them ill and not in an acceptable time etc. they were assessed by a psychiatrist and have letters with diagnosis and detailing how extreme their health conditions are. their doctor prescribes medication and wrote a letter also detailing their health and how they can’t do these things.

pip claim was sent with medical evidence. the decision maker said each activity can be done with prompting. an mr mandatory reconsideration was sent. the decision maker said there is no cognitive problem or safety risk and medical evidence does not support the claims. surely that is wrong. the doctor said they think it is wrong and they are discriminating against mental health.

1 do you know if they rule against mental health conditions for these activities because it seems they are saying higher points are only given for certain health conditions?

2 given the extreme health conditions and strength of medical evidence do you think it is likely the decision could be overturned if it went to a tribunal?

I can't comment on whether they would receive an award / higher award if they go to appeal, many of the PPIP activities do not directly increase in severity as the points go up, often additional criteria has to be met, see our PIP Claim guide to see what criteria needs to be met.

Did they explain why prompting would not be sufficient to overcome their problems?

They need to be able to complete the PIP activities "reliably" and "on the majority of days", both of these terms are defined in the guide.

Our PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

Hi Gordon.

a lot of research was done with guides and PIP guidelines to try to make sure it was thorough. the health practitioner was nice, assessors guide wrote the claimant showed anxiety and needed prompting on questions, then suggested prompting for activities, not sure if they and the decision maker used the assessment for decisions not the claim details and medical evidence.

the PIP claim and MR mandatory reconsideration pointed out all issues, explained why prompting or assistance did not help, how the health and illness restricted ability to do activities. made clear about reliably because they can’t do activities on the majority of days.

they will probably go through the forms again but i don’t think there is anything that could be improved, they covered everything they could with strong medical evidence and expected a higher rate. they are considering a tribunal. it is useful to know there is a high success rate.

the PIP resources I assume you mean the “guide to pip claims and reviews”, please could you advise which page/s has the criteria?
