[ Hi Gordon,

Please can you help me with some advice.
I have been awarded the standard rate for daily living P.I.P. I failed to get points for Moblity
descriptors scoring 0.

I took the decision to appeal and that has been posted back (all sent in time recorded post)
I am still somewhat uncertain as i know i could lose all the award but i have done it anyway.

Here is my question i need help with today. My DLA ended on 18 February. I was told that my P.I.P would be paid from 20th FEB. to 17th March as it is paid one month in arrears. I was paid 219 pounds 20p (sorry cannot use the actual pound sign in keyboard for some reason it is just not working) I have just realised today that is a few pounds short as the rate is supposed to be 57 pounds 30p a week.

I have just received a letter from D.W.P saying the rates are changing on 8th April. I already knew that. They say my current weekly amount is 57 pounds 30p. They say my new weekly amount will be 58 pounds 70p.
They say quite matter of factly You may get paid less your weekly amount if your payment is affected by other benefits, for example, you have a Motability agreement or you are paying money back to us.

I was not aware that having a Motability agreement had anything to do with daily care payment.
I actually spoke to Motability agreement scheme on Monday updating them that my appeal has gone in. My information from the Motability has been that i can still keep my vehicle up until 31st July and then if i want to i can hand it back and receive 500 pounds for my transition. My other option with them is i still keep the vehicle all the way up to appeal as long as i keep them informed as to what is happening. The specialist at Motability explained to me that if the appeal goes in my favour I will be paid the backdated money by D.W.P. and then i pay any outstanding rental to Motability sheme. If i am unsuccessful the vehicle goes back the day after the appeal.

That is the part i am more stressed over if my brother can find me a little car suitable for my needs i will get it and hand the car back before 31 st July. Obviously it will not be as good as the Mobility sheme but i am trying to look at this in a practical manner. Also i know i can pull out of the appeal if i want to although i do know i was sold down the river by my assessment report. I complained to N.M.C governing body of nurses and they have taken my complaint seriously and last week i have heard that they feel i could have a case against the asessor apparently she was a registerd nurse. it does not make me feel good complaining about nurses etc, particularly when all staff i have met in N.H.S. over the years have been excellent.
Any way not wanting to make this any longer but what do you think the D.W.P mean about stopping me money if i have a Motability agreement? Also i am not paying any money back to D.W.P

Oh yes they say that any payment covering 8th April could be made up of new and old amounts. Any advice is appreciated.

The Annual Entitlement letter is standard mine make the same reference to Motability and we don't have a car.

As to the payments, you need to wait until you have received your first full PIP payment and then you can look back across the previous four payments;

1. Last full DLA payment
2. Last DLA payment
3. First PIP payment
4. First full PIP payment.

Both (2) and (3) are likely to be partial payments but you won't necessarily be aware of the dates that they cover. Once you have all four you should be able to see if there is money missing.
