I am looking for some advice. I am currently in the support group of ESA (income related). However my partner is thinking of starting work, 2 days a week for 16 hours. I have read that he can work up to 24 hours. We have been to the CAB and they have said we would be forced on to Universal credit? At the moment it would push us into financial hardship, and would prefer to stay on the old system for now. The idea is he will work more and we will eventually come off benefits completely. I am just looking for some correct advice, as everything on line seems to be mixed. It's either we can stay on the current system if he doesn't work more than 24hours, or move on to universal credit.

Based on your post I can see no reason why you would have to claim Universal Credit but it is possible that you would be better off doing so.

If you stay on ESA then there is a £20/week disregard but after that your partner's income will be deducted £ for £ from your ESA.

Under UC the LCWRA rate (the same as ESA SG) is higher and rather than £ for £ their earnings will be deducted at 63p for each £.
