Two years ago , after 8 months of stress and poverty, I finally won my tribunal and was reinstated into the support group. My spinal problem is degenerative causes me content pain for which I take variety of poly medications, also have nerve damage down my left leg, mobility problem fatigue etc egg...you get the picture. I also have osteoarthritis the length of my spine, in my neck my knees and my shoulder. Since my tribunal I have degenerated some more, but I know I will still have to jump through the two's hoops to prove I'm worthy of my benefit.
My question is...should I mention on my esa50 in the back section pertaining to anything else they may need to know , that I went to tribunal 2 years ago , where the decision was given that the dwpI should give me my full 15 points straight off, on mobility grounds ? Should I mention this ?
Incidental, and a warning here for anyone attending a face to face medical; INSIST that your health care assessor fully carries out the physical examination section of the assessment. They may tell you this is optional. My assessor, a retired asthma nurse and not a musculoskeletal or Neuro specialist, suggested to me that...as I looked to be in a great deal of pain, I could forego the touching your toes test and all the other physical tests to assess my condition. I thought she was being kind but the reality is, the physical component is optional.and if " refused" by the claimant, then you receive zero points for any physical assessment of your condition. So INSIST that thid examination be carried out and don't be hoodwinked into foregping it. It's a sneaky tactic and will cost you points.

Hi Foxy,
I always include copies of all my won appeals DLA, PIP, ESA from the judges decisions notice every time i am re-called up for re-assessments.
As i believe its supportive evidence that you was originaly in the right and they were in the wrong. Thus the ASSESSOR and DWP MD will be reminded of that fact.
Hence they will know you mean business if they dont get it right next time around at the next assessment. Its not a threat to them in any way, its just a reminder that they got it wrong.
