Gordon is usually on line between 8.00 pm and 9.30 pm but he does drop in at other times.

Gary, I only saw your reply after I'd sent mine to Gordon - thanks very much.
Before either/both of you for the night or in case you only read this tomorrow:
I don't have time now to explain but I'm having ridiculous, non-sensical issues with getting IAS to do a PBR instead of a phone one because I am cognitively too ill to. Where things currently stand is IAS have passed my case back to DWP and have said that I have exhausted their complaints procedure - is they will no longer be dealing with my claim anymore regardless of anymore complaint letters I send in. This next letter to DWP is to get in quick to prevent them from stopping my claim. I currently have an pressing/urgent medical treatment to deal with and no spare energy whatsoever to comb through IAS's latest letter of illogical nonsense proving why it is that and send this to the DWP. Until the medical treatment is over, I am going to provide the DWP with an interim letter including e-mail correspondence with the practitioners treating me and that extensive forms are required for me to complete beforehand, ie using up all my cognitive energy.
But what I want to know (apart from the logic and common sense that pressing medical treatment takes precedence over PIP) is, is it written anywhere that as a claimant I have the right to seek medical treatment before dealing with ongoing PIP issues? Because with the DWP being so dishonest (generally and specifically with my complaint letters to them re IAS), I don't trust them to just employ common sense and human decency by allowing me to respond to IAS's letter in detail at a later date after I've recovered from treatment. Hence, why I want something concrete to put in writing to them?

One last question before I got to bed as my head is now mush:
If the DWP decide to ignore that this pressing medical treatment has to take priority of my cognitive energy over dealing with PIP, is it written anywhere that a claimant has the write to take time to respond to an IAS letter (correcting untruths, illogic etc)? IAS said that they didn't forward the DWP a copy of their first letter to me (responding to my IAS complaint letter) but fortunately I know better and sent the DWP a copy of this at the time. So IAS are unlikely to forward the DWP a copy of this latest letter - they will simply have handed my case back to the DWP providing who knows what untrue reasoning for doing so...hence my urgent letter to the DWP. So although I don't have the time/energy now to comb through this latest rubbish from IAS and tell the DWP why it's rubbish, I want to at least include in tomorrow's letter that I will be doing so at a later date after I've recovered from this medical treatment. So hence my question of is it written anywhere that I have the right to defend myself against IAS's latest letter of untruths (if they do forward a copy to the DWP) or whatever untrue reasoning they give the DWP for handing my case back to them, which might prompt the DWP to just stop my PIP claim?

My last question I think for this letter:
Is it written anywhere (that I can quote back to DWP) that the DWP (or IAS) HAVE to confirm to claimants the accompanying evidence that they have if we provide them with a list of every single item that should have been scanned and visible on their system? With my PIP1 I asked the DWP 2-3 times to confirm if they still had the evidence from my last DLA claim in a list I provided them - they ignored all my requests for this confirmation. In my recent letter to the DWP, of which I sent a copy to IAS, I asked for the DWP to confirm the looooong list of accompanying evidence I had provided in my PIP2 and subsequently - the DWP still haven't responded but IAS didn't confirm any of it in their recent reply letter.
From something written in this latest IAS letter, I realised I can PROVE that either IAS don't read all my evidence, or IAS don't have all my evidence to read. And I'm talking about the main part of my PIP2 evidence (answers) that I'd printed out and stapled to the booklet pages, not even the accompanying/supporting evidence!!!

Going down the complaints route with this may not be in your best interest, the process is separate from the assessment process, is handled by a different team who may even be in a different building.
You would be better off just writing to the DWP office dealing with your claim as they will be the ones making Decisions on it and you want them to understand the difficulties that you are currently having.
Your current health should be a factor in how the DWP decide to progress your claim but remember, you have a Fixed Term award, it will end on the End Date whether you have been assessed or not unless your current award is extended or another one replaces it.
I understand your frustration with IAS but there are two things operating against you.
First, there has been no Decision on your claim so I would not expect them to discuss any of the details of your assessment with you, this would include what evidence they had used.
Secondly, they are not Data Owners and therefore do not have to respond to requests for information, these need to be directed to the DWP.
Yes, you can respond to any comments IAS have made to the DWP about your assessment.
If I have missed anything then post again and we will try and respond.
