PIP: how to prove how far you can't walk?

PIP: how to prove how far you can't walk? was created by alisp
Can anyone please suggest a way in which someone can *prove* you can't walk further than a specified distance? How do you prove a negative? Isn't it like asking someone to prove they weren't guilty of murder when they don't have a cast-iron alibi?

Hi alisp
Get as much supporting evidence together as you can which supports your claim such as reports from specialists including pain clinic. You have to show and explain why you cannot walk further than a specified distance, what effect does it have on your health, how long do you have to rest before moving on, can you repeat the task. Have a look at page 61 from our PIP guide
www.benefitsandwork.co.uk/help-for-claimants/pip this will help to explain what you need to show.
As to the second part of your question, you are normally innocent until you are proved guilty.

Hi Gary - wasn't expecting a reply this late! No pain clinic because no pain, no specialists because the "specialists" seem to be largely people who believe it's a mental health condition and will carry on doing so until late on next year, and probably beyond that even once they are officially told otherwise.

Hi alisp. It really helps to have letters from your doctors, specialist teams etc. To support my claim that I could only walk up to 50 metres I supplied my PIP assessor with a recent letter from my MS nurse that stated I was only able to walk short distances due to fatigue and balance issues.

Did the assessor actually say there was 'no evidence' that the claimant has difficulty in walking? All you can do is counteract what they say - but you will sometimes struggle if there is no medical evidence to back it up. You could include some sort of diary, documenting difficulties in walking, any letters from friends or family who have witnessed the difficulties, and you can also argue that an hour's assessment can not fairly judge the claimant's ability to walk.
