Universal credit work capability question

Hello

My son has been put into LCWRA group without a face to face assessment as it was decided they had enough evidence to make this decision without seeing him

I must confess to being surprised and a bit crushed! I really thought he would be placed in the limited capacity for work group as i am sure there must be something he can do and i was hoping his work coach would be able to get him on the road to employment.

So i was hoping a letter will come through showing where points have been awarded. But day after day, our postman brings nothing.

There is a letter in his journal account, a scan of the official letter showing he has been placed in LCWRA group but it doesnt say how long he is in this group for or give any info as to how they arrived at this decision without seeing him.

As soon as that letter went onto his work journal, communication with his work coach stopped and an enquiry i made receieved a reply from someone in a different centre altogether.


Will a letter come, explaining where points were awarded and how long he is in this group?

Or do i need to request that?

Universal Credit LCW and LCWRA Decisions do not include an End Date or Award Length, the award is for an indefinite period but with scheduled reassessment.

You need to request a copy of the UC85A assessment report, he should be able to do this via his UC Journal but the request may be actioned more quickly if a call to the UC Helpline is made.

The LCWRA Element is not points based, he will have met one or more of the associated Descriptors.

Thanks. I have looked at those descriptors and i dont think he meets any. I have made the request for that report.

I have a feeling it will be the one about seqential personal actions. So my son has an initiation of task cognitive problem which makes him passive and needing prompts. But the prompt could simply be 'remember to have a shower and wash your hair'

He has not got that profound level of disability where he cannot sequence his way through a task.

I just told the truth on his application. I genuinely did not over exagerate or say anything at all that wasnt true. But i have a feeling this is a mis interpretation of what i wrote.

And now im in a dilemma because if i say to them he isnt severe enough to justify being in that group - it could damage his pip claim?

He does need a lot of help - but there are definitely things he could be doing to get ready for work.

In fact, he is doing an unpaid work placement just now (the job centre know this)

What a pickle!

Will wait for explanation to come and see what it says.

Anisty. it does state on my UC LCWRA award that I can still look for and do a job if I wish and that the job centre would provide support. Your son can still find work if he wants and he should not have to worry about sanctions and harassment from the job centre with this award in place.

I'm not sure if this applies to UC but I do believe that your son may well qualify to do permitted work. It's just a thought.

The best thing to do would be to have a meeting with his work coach, they may be able to put in place training/support.
