overpaid on my income related ESA payments now??

I am on income based ESA support group for over 10 years now and I was reassessed for another 3 years more till Nov 2022,the same period with my PIP .I got first time my PIP in 2017( both components on higher award) and my husband is my paid carer .My payments for pip have not changed during that period but my ESA payments have gone up this month..I am the person claiming as a family for my husband too ,income bases ESA , who cannot take his pension yet (born 1954) till I am in my pension age too(born 1963).He is paid £66 as my carer and we got ,till end of 2019 , £148.20 per week from income based ESA as they deducted his £66 Carer's payment from the £225 appr that the law says that would be our ESA payment and added some disability premium and finally we were paid £148.20 per week .Since 2020 that amount increased for ESA to £225.95 per week the PIP amount remains the same as the carer's allowance of £66.15.When I put my data to TURN2US site I have that same figure of £225.95 (no deduction of my husband's carer allowance £66.15).So I am confuse on what is right .Am I overpaid now (2020) or I was underpaid previously on my ESA ?? ..

£114.85 - Couples Allowance
£ 38.55 - Support Group
£ 24.10 - Enhanced Disability Premium (Couples)
£ 36.85 - Carers Premium
======
£214.35
£ 66.15 - Carers Allowance
======
£148.20

You say since 2020 the ESA amount has increased, has anything changed with your or your husband's benefits?

I can't see where the difference is coming from as it is an odd amount of around £77 which does not match with any of the ESA elements.

In DWP letter sent to me last August (2019) it was stated that I was in the support group following my reassessment and they made the same calculations like you, saying that I would be paid £148.20 for ESA .In addition they stated that this amount will be £225.95 from 1 January 2020 with no further explanations..The only possible explanation in my mind as change of circumstances is that in January my husband is normally entitled to his pension .I claim for the family and we cannot take the pension as a couple since I need another 9 years to be in pension age .Do you think that this can be the explanation for the additional (gratefully)£77.75 ??

It can't be due to a pension as his receiving either the State Pension or an occupational one would in fact reduce the amount of ESA that you are entitled to, £ for £.

What if we split as a couple and goes to live close by but continues to be my carer and inform DWP about that change .Would he be able to take his state pension with pension credit and the carers allowance on top or it is going to be reduced for £ for a £ above any permissible level of weekly money??In that case I expect to get the same PIP payment and obviously my ESA would be reduced but by how much?

Hi Paul

You cannot claim CA when you are in receipt of SP, what you can get is an underlying entitlement if you claim PC which would give you an extra premium.

In regards to your question about ESA, your ESA would go down as you would now claim as a single person, if you are in receipt of the DL of PIP and no one claims CA for caring for you, then you could get an additional premium SDP.

You need to seek advice from your local welfare rights worker to get informed information about your circumstances, they can do better off calculations.
