PIP appeal was created by luthersgirl
I applied for an appeal on 7th feb for my PIP award as it had been lowered. I had an email back from tribunals stating DWP has to respond to your appeal by 12 March 2020 but so far they haven’t. On chasing this up I received this back;

We are still awaiting response from the DWP with the current situation
things are moving slower than normal.
DWP are currently running a reduced service due to the COVID-19 situation, so we are not able to send Direction Notices to DWP until July 31st. DWP's request for this has been agreed by the Chamber President.
You are currently 16 weeks live with your appeal with the courts, the estimated waiting times for ORAL hearings for PIP at the Venue are
Between 53 weeks and 58 weeks’ time

This I find disgraceful as DWP should have replied before our lockdown even started. I’m so frustrated any help to what I can do please

Hi Trace

I can't offer you any comfort on this one I'm afraid. You can put in a complaint, with the DWP, but I don't think you will receive any reply that would satisfy you. Even before COVID, appeals were taking on average 45 weeks across the country and in some areas longer. It's not good and it's traumatic for those waiting but unfortunately, that's the current situation. You could try writing to your MP about it.

Hi thanks I’ve just finally had a letter from DWP well not a letter more like a book it’s 100 pages in total how on Earth am I expected to understand this I would think now they’ve replied to me they are going to send the same info to the tribunal . Is it best I cancel the whole thing now as I’m completely lost

Only you can decide whether you want to proceed with the Tribunal. Have you looked through the 100 pages? Am I wrong in thinking that some of the 100 pages must be your original claim and the mandatory reconsideration?

As the wait for the case to be heard is still a long time, you may want to continue with it and wait until you have the opportunity to speak to a Benefits Advisor in your area. I realise this may not be possible.

Hi Trace

What you have received is the appeal bundle which should contain copies of your original claim, assessors report, your mandatory reconsideration and supporting documents.
The main document to check is the assessors report as this is what the tribunal usually will concentrate on. If you do not already have a copy of the report, go through it carefully and bullet point any inaccuracies. If you have any missing supporting documents then send it to the Tribunal Service not DWP.
You may get a call from DWP before a hearing date with an offer, you do not have to accept this offer if you believe you should get a higher award and it might worth arguing for higher premium over the phone, you have nothing to loose.

Hi Trace, just another fellow member here, not a mod or anything. But I would back up what's been said, hang on in there, during the delay you may find someone to help you. In the meantime, you may or may not find my methods worth trying. If you can, get hold of some coloured paper and or bright sticky notes and a lined pad, bigger supermarkets often sell these.
Limit yourself to how much time per day you look at the thick bundle to limit getting confused. Use your coloured paper to split it up into sections and label them. Use the sticky notes to help you locate any queries in the assessor's report. As you go through, use the lined pad to make any notes, always with the 'bundle' page number on, and keep the pad with the bundle. By doing all this you put yourself back in control.
And if you do get help, it would assist any benefits adviser in getting to grips with the story so far to have it marked up.
I'm such a wuss I have to reward myself with tea and biscuits after a session on the papers - but our daughter won enhanced on both PIP daily living and mobility at the tribunal after I did all this.
