I'm in the process of complaining to the Independent Case Examiner and I'd welcome any input on a couple of points:

1. In the PA4 (Assessment Report) there is frequent mention of Mental State Examination (MSE) in the justification of descriptors chosen. However, there is no mention of which tests or any results from them. There are only generalised statements about appearance and presentation. When I had my DLA to PIP assessment there were some tests done (poor ones) and the results appeared on the form. Is it now standard to claim that observations are an examination?

2. I can't find anywhere in the DWP's PIP Assessment Guides any mention of a Mental State Examination and, of course, the PA4 form itself doesn't have any reference to an MSE and whilst it confirms approval of a Physical Examination there is nothing similar for an MSE. It also of course isn't headed MSE on the PA4 form just Mental State. Does anyone have any offical DWP documentation which mention a PIP MSE and what it should contain?

I've been moderating for about ten years and I have not seen a full MSE reported by a member either from the assessment or the report.

There are two examinations, a basic one of thirty questions that takes about ten minutes to be administered by a clinician trained in its use and detailed questionnaire that takes at least half an hour to do and requires two clinicians with specific training, one to run the test and the other to observe the person while they answer.

The basic test, I don't think I have seen more than three elements used based on what has been reported by members is not definitive and at best is an indicator that additional testing is required. Much like the claimant filling to rock or their having good eye contact, the "MSE" given is really not sufficient to make a benefit decision on whether they need prompting or assistance as it often is.

The test appears to be used by assessors that I would characterise as being at the less professional end of the spectrum, Decision Makers who have no medical training often give the results unreasonable emphasis when making their Decision.

To answer your questions;

1. It is not standard but is something that we regularly see but bear in mind that the majority of posting on the form is done by claimants who have not received the award they expected, rather than the significantly larger number that have.

2. I am not aware of any reference to a Mental State Examination in any of the PIP documentation, it is possible that it is included in the training material but there is no way of knowing as there is virtually none of this in the public domain.

Many thanks for that Gordon - it is as I expected. I'm 99% sure that there wasn't any form
of recognised MSE and that is why there are no results quoted. I also find it very interesting that the difference between the MSE and the Musculoskeletal Examination (ME) is really stark. In the MSE it is very generalised but when reporting the ME it is all about specific movements and percentages - I can't tell how accurate they might be but at least they could be checked by another health profession.
The MSE is used no less than 11 times in the descriptor justifications to reject CPN letters, GP letters and even the 2017 PIP assessment. I don't accept that there was any MSE or even that this is what the DWP expects there to be. After all it is on page 10 which is headed in bold Observations and Mental State is just one of three sections on that page. That the MSE isn't mentioned at all by the DWP also supports that contention.
I'm in the very fortunate position that my award remained the same and is now on an ongoing status so I can keep up the complaint without having an MR or appeal to do. I just want to check that I haven't missed anything before submitting the complaint.
