Tribunal PIP Question?

Hi there, just have 2 questions:
1)I originally got 4 points in daily and 4 in mobility, then I applied for MR and got 12 points in mobility and no change on daily still 4 points, my question is can I just appeal the daily alone on tribunal?
2)So if it does go to a tribunal, i'm aware they can request further medical requests (rare from what I hear) but only with my permission. So what if i choose to refuse (some unfavourable stuff for example), what happens then?

1. Yes, you can limit your appeal to just the Daily Living component.
2. There is a UTT Decision that says that panels cannot infer anything from a claimant refusing access to their medical records but you should understand that this request is only made when the panel believe that they can only make a Decision if they have the information, so you may be limiting your options for a successful appeal.

I think I may proceed with the daily then, I have nothing to lose.
I just got the MR letter today and i'll get paid tomorrow.
Do I need to wait for PIP to call me first, so I can accept the decision. Then I can appeal? I'm worried that they may not even call me?

There is no Decision to accept, the MR has revised the original Decision to award the Mobility component, I would wait until you have actually been paid your PIP but once you have you can then request an appeal for the Daily Living component.
It will only be if the DWP make an offer once you have appealed that you will need to decide whether to accept it or not.

Just 1 last question, is there any information from clients as to what's going on with the tribunals right now? are normal f2f appeals being held by the telephone now? or paper based? or does it come down to the courts discretion as to what they offer you in general during this covid-19 period?

I would not worry too much about the current situation there are long waits for hearings and the situation will likely have changed by the time that your hearing is convened.
