The purpose of form ESA3 is to enable the decision maker to determine whether people receiving contributory ESA might become entitled to income-related ESA following a change of circumstances.

You can only claim the old types of ESA if you’ve been getting a benefit with an SDP.

The answer to your question would depend on what benefits you are receiving.

Hi i have been sick since 25 may my wife claims UC DWP says even though i have no saveings i cannot claim ESA3 as this benefit has been stopped i would love to know if this is true as the lady i spoke to did not sound very convincing.

The ESA3 is a form used by what is now called legacy ESA, it is not a benefit.

If you have claimed UC then you cannot make a claim for any legacy benefit, this includes legacy ESA, however, if you have sufficient NI Contributions in both of the Tax Years 2017-18 2018-19 then you can make a claim for New Style ESA but you may not be better off by doing this as the NS ESA will be deducted from your UC £ for £.
