Good morning everyone. After requesting an MR, I have been granted PIP standard for both standard living allowance and mobility and have had my payment backdated from Feb, so great outcome.

However, I am confused...... Until March, and being told to shield due to covid, I was self employed and worked, receiving minimal support for housing and working tax credits. £18.00 per week. Due to cover I had to stop work, and go on universal credit, and claim SEISS. I have received notification from the Council, who were paying my housing benefit before Universal Credit, saying they paying me SDP for the period feb/March??? why is this, and if I have been awarded the SDP payments will they also be back dated and paid by whom?.

I was unaware of this premium so am not sure what to expect.

You can only get a SDP whilst you are/were in receipt of a means tested legacy benefit such as HB, as soon as you apply for UC then you are no longer eligible to claim a SDP.

The council have been notified of your award which was backdated, this would have given you an extra premium of £65.85 pw during the period in question as at that time you were in receipt of a legacy benefit, the premium increased in April 2020 to £66.95 pw.

Thank you Gary,

This is all new to me. Do you know what else I may be entitled too and can claim for? If I was eligible for an extra £66 per week, where has that gone, or what else is is called? or am i only entitled to pip. I get UC which at the moment is 409.00 and some housing benefit

You can put your information into one of the online benefit calculators to see if there is anything you can claim

but if are receiving PIP and UC then I would be surprised if there is anything else.

You were entitled to the extra HB before you claimed UC but claiming UC removes that entitlement.

Ive just spoken to citizen advice and they said because I had a legacy policy, housing benefit, in place when I applied for UC, and the fact that I had applied for PIP in Feb,but not awarded until Oct, before going on universal credit at end of March, I shouldn't have been put onto UC, and the SDP gateway should apply.

Would you be able to advise the best way to challenge this with UC

It is not that easy, you did not have a legacy benefit with the SD Premium in payment when you claimed UC, this only became the case when your MR revised the original PIP Decision.

So, you do have the option of going back onto legacy benefits BUT this will mean you are starting from scratch again, you should be able to get your HB reinstated but you will then have to make a new claim for either JSA(IR) or ESA(IR) depending on whether you are fit for work or not.
