PIP and supreme courts ruling was created by patsy166
I was awarded standard rate for care and mobility in 2017. I have autism, complex mental health issues and I’m disabled. I feel that I should have been awarded the enhanced rate for mobility because I can’t go out without support to appointments etc and can’t plan and execute journeys. I also have communication difficulties. I have recently asked for a review and have submitted the application form and additional information. At first I was told I would have to have a telephone assessment, but after the assessor spoke to my Psychologist she decided that I didn’t need a telephone assessment and she has completed her assessment using the form etc. I now have to wait for the decision letter and copy of her report. I initially challenged the DWP decision and went to a tribunal who upheld the original decision , does that mean the DWP won’t check to see if I was entitled for the higher rate in 2017?

Hi Patricia
In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ
My full name is showing, how can I stop it?
If the tribunal upheld the decision in 2017- no the DWP won't look at that decision. You asked for a review which will be treated as a 'change of circumstances' and it should be backdated to the date you make the request - if you are successful in getting an improved award.

I sent one of your template letters to look at my pip awards due to the high court ruling etc. Sent a couple of months ago and heard nothing. Anyone else done this and had a response of any sort?

Hi abbievdub
I haven't heard of anyone hearing back and that is not surprising as the DWP have yet to make it clear when and how they are going to proceed since the ruling.
