Appointee rights for telephone assessment

I noticed in a news item it says:

GETTING SOMEONE ELSE TO DO YOUR PIP TELEPHONE ASSESSMENT
... One document sets out the circumstances under which you can get a family member, carer, friend or support worker to replace you at your PIP telephone assessment.

... This is not about claimants who have an official appointee who is already legally entitled to make representations on their behalf.


As appointee for my daughter for her original claim for PIP after trying and failing to get my daughter to attend due to severe anxiety, the assessor talked to me, and subsequently my daughter was awarded enhanced PIP due to her mental health disability. For various reasons then, and now, it wasn't and might not be possible to submit up to date medical information other than her prescription list. I don't know if the health assessor contacted the doctor or DWP asked the doctor for evidence (or her counsellor).

3 years later, the claim is being reviewed, and I'm worried we will be in exactly the same position with my daughter being too anxious to attend. I'm also worried if she does attend, she will mess up the assessment because she always tries to put a brave face on and answers how she thinks the person wants her to answer. She is also embarrassed about her condition and so often acts as if she is fine.

It will be almost impossible to get my daughter to attend a telephone assessment, and for me to be there at the same time. She doesn't have a speaker phone we could use for us both to attend and the mobile signal where she lives is almost non-existent.

Given the news item above, I wondered if as my daughters appointee I have a right to attend a telephone assessment on her behalf (and in her absence), giving my telephone number instead? Can I avoid the process of trying and failing to get my daughter to attend (which is what I did last time) and get them to arrange the assessment with me in the first place.

No, I'm afraid you do not have a right to attend an assessment without your daughter being present but that does not mean that the Assessment Provider will not accept you doing so.

You need to present the problems that your daughter would have participating in a telephone assessment and also that she lacks insight into her problems or attempts to hide them. Push for a Paper Based Review but as a fallback position for you to handle the interview in her place.
