Hi, I am in receipt of old style 'legacy benefit' ESA, SDP, PIP and HB. I am also under notice to leave where I am living because my LL wants to sell. I am very confused about the rules regarding legacy benefits, SDP and triggering new UC claims if I move out of the borough that I currently live in. I am in London and my borough has a high waiting list for social housing, a huge rental sector but as many here will know, many LL's won't touch someone on HB. I would be very gtrateful if someone could tell me if I would have to start claiming UC rather than stay on my current benefits if I move out of the area?

If you move within your current Local Authority then you can do so without having to claim UC, you don't need to make a new claim for HB, your existing claim will be modified.
If you move to another UC before 27 January then your SD Premium bars you from claiming UC and you can make a new claim Housing Benefit and retain your ESA.
If you move on or after the 27th then you will need to check back as the "SDP Gateway" is due to be removed on this date and moving to a new LA will result in you having to claim UC, however, you should be able to get Transitional Protection of your SDP payment.

Gordon, thank you so much for responding such a clear and concise manner. I am now feeling SO angry as the woman I deal with at the council has previously told me that if I moved area that I would have to move into UC which means I have wasted over 6 months because of her incorrect advice! Thank you so much for your help.
