Hello all , today I got round to reading the DWP paperwork which they sent to the tribunal. Which is a load of rubbish, untruths , I thought I’d seen it all until I read on a few of the sections that they had called me by a completely different name . I am going to send a letter to the tribunal pointing out all of the untruths . Do you think I should point out that they were addressing me as a different person.
Also do I have to send a copy of my letter to DWP

My first advice is not to do this piecemeal, write one response to the Tribunal Service, making multiple responses creates an opportunity for your case to become fragmented and confused.
Definitely, mention any document which has the wrong name on it, ask for the document to be excluded on the basis that it cannot be confirmed as applying to you.
Remember, the panel can only make an award by your showing that you meet the criteria for one, sometimes it is necessary to argue the inconsistencies in the report in order to show this but don't get bogged down with doing this, showing the report is wrong will not get you an award if you have not first shown that you should score the points for one.
There is a guide to dealing with the assessment report in the PIP area.
You should only send information in regard to your appeal to the TS, they will send a copy to the DWP.

Hi Karen
Piecemeal means in bits and pieces. Gordon was suggesting that you send one single response to the Tribunal.(You had also mentioned sending to the DWP, but that's not necessary - the Tribunal Services do that.)

Thank you for your advice. I have read through everything again today and I’m in such a muddle. The HP put things that I never said, ( I recorded the telephone conversation and have listened back just to be sure). The decision maker put different things again and referred to me by someone else’s name. I’m finding it extremely difficult to write a single response to the Tribunal that sums everything up. I have read through the pages on here but I’m just getting myself in a right state. I don’t have the knowledge and words to do it correctly.

I know it feels daunting, but try not to let it get to you. Take one question at a time. What has the assessor said? Do you dispute it? If you do, say why and refer to what you might have said on your original form or what you said or didn't say on the telephone assessment. If you submitted any additional evidence like a doctor's letter - then say so. Expand on any answer if you think you weren't quite clear. Don't get bogged down on points that won't score you additional points. You can always put a summary of additional points at the end (including that the DWP don't appear to know who you are as the decision-maker doesn't call you by the right name). Don't put pressure on yourself to try and write your evidence the 'right way'. Remember you're an expert on yourself, your conditions and how they affect you. That's all you have to say.
