PIP review after Supreme Court hearing for mixing was created by abbievdub
I wrote to the DWP requesting they review my PIP claims inline with the Supreme Court hearing in regards to the needing support from professional to mix with people and communicate etc.
I just had a call from the DWP saying they can’t not review my claims between 2015-2018 as they went to court? And 2016 claim in our of date to be reviewed??

As BIS stated in a previous post #252918, we haven't heard of anyone hearing back and that is not surprising as the DWP have yet to make it clear when and how they are going to proceed since the ruling.
For a claim to be reviewed, it has to be requested within 13 months of the decision date.

Oh yes I know but I’m saying I sent your template letter requesting they review my claims and they JUST called me in response to it. Saying that it’s too late to look at my June 2016 claim and previous claims went to court so can not be looked at. However now they want to review my current claim as an early review not because of the court case. So I have inadvertently given them the chance to just review my current claim completely and 4 years early!
So I’m now very regretful of asking them to look at the claims. I was following the advice off this website

I have look through the posts, I am not sure what advice you require, if you require specific advice on a issue then we would advise you to seek help from a welfare rights worker, as on the forum we cannot go into specifics as we do not have all the relevant information, we can only give general advice/information.
In regards to being reassessed, ESA is an indefinite award with scheduled reassessment based on the Prognosis Date completed by the assessor in their report, so your existing ESA award continues in payment until a new Decision is made. ESA is an indefinite award with scheduled reassessment so there will be no end date or award length on the Decision Letter, exemption from further assessment has only been in place a couple of years.
ESA assessments can be anywhere from 3 months to two years for the WRAG and three years for the Support Group, you state in your post that you are being assessed 4 years early.
