Hi everyone, could you please give me some advice. My daughter had her PIP stopped in August, she had a telephone interview abd the person from DWP decided that she no longer needed any help. I appealed against this decision as my daughter has Bi Polar Disorder and does not fair too well with people she doesnt know or cannot identify with. My point is they have now sent her a letter telling her that they will reinstate her original award which she received for an injury she sustained many years ago on her hand, theyhave not taken into account her mental illness, spina bifida, and generalised pain which her GP sent a detailed letter explaining how her mental illness and generalised pain effect her day to day life. I have already started an appeal at the tribunal before the letter from the GP was sent. if she accepts this offer and she gets new supporting evidence after can she make a new claim and would she be allowed to put forward the same detailed letter fro her GP? Sorry for long drawn out question but its very difficult trying to make this brief.

From your post I don't know what your daughter has been awarded and what she was hoping to be awarded.
What she can do is wait for payment to be put in place before putting in a new appeal. You usually get a letter from HMCTS informing that your case has been closed due to a decision made in your favour, if you are not happy with the decision then you can re-start the appeal without having to restart her claim.
You will need to explain why you are appealing and not happy with what has been offered, at this stage you set out why you are appealing and include any addition support documents.
Remember they will only look at how your daughter was when she was assessed and not how she is now.
Make sure that you understand the criteria that your daughter is being assessed against, you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.

Hi Gary, would the fact that they have not taken into consideration her mental health and generalised pain be a good reason to continue with her tribunal appeal. My daughter was awarded PIP about 5 years ago for an accident she sustained on her hand, she got standard rate care, that is what they said they would reinstate, so they have totally ignored her GP's letter explaining how her conditions have impacted her day to day life. Thank you.

I can not give you an answer as I do not know your daughter, you have to remember PIP is not awarded because of the condition but rather the limitations that result and prevent a claimant from completing a range of everyday activities. Have a look at our PIP Claim guide for a better understanding of the criteria you will need to meet.
