House move - legacy benefits to universal credit??

Im currently on ESA, and live in Leeds, West Yorkshire
I'm looking at moving to a property in Drighlington which has Bradford in the address, but is managed by Leeds city council. (The postcode is BD11).

So I wanted to ask, if it's managed by Leeds council, will I remain on ESA after moving house (change of address), to this BD11 address because it is managed by Leeds council, or will they see Bradford in the address and what seems like a Bradford postcode (BD) and tell me to apply for universal credit because they deem I have moved out of my current local authority area.

And does the same answer to this question apply to the DWP/Jobcentre plus side of things as well as the council housing benefit side of things.

Any help is much appreciated

Thanks

Hi Mike D

ESA is not dependant on where you live. From your post I do not know if you are in receipt of IR ESA or CB ESA. I have assumed you are in receipt of IR ESA, if you do not claim any housing benefit then it does not matter where you move to, you will remain on IR ESA. If you are in receipt of housing benefit, then if you move from one local authority to another then your IR ESA will cease unless you get a SDP paid with your IR ESA (this will make no difference from the 27th January 2021).

It does not matter who manages the property, it is dependant on who the Local Authority is, if you have moved LA then you will have to claim UC.

Thanks for your reply Gary

Well it turns out that the local authority for Drighlington is Leeds city council so I would be remaining with the same local authority that I'm currently with after moving to Drighlington. I've checked with Drighlington residents and they pay council tax with Leeds city council and all online literature reflects this. So from what you say I assume my housing benefit would be unaffected by this change of circumstance.

And my only concern was with the ESA change of address, I need to check which type of ESA mine is, IR or CB, but are you saying my ESA (IR or CB) would not be affected if I moved to a Leeds council area, or a new local authority area such as Bradford & Bingley?

Thanks

Mark

Thank you for your reply Gary

Well as it turns out Drighlington comes under the Leeds council local authority, so I assume my housing benefit would be unaffected by this change of address from what you say.

I need to check whether my ESA is IR or CB, but are you saying that if I moved to a new local authority area my ESA would be unaffected?

As it happens I think the local authority area would remain the same after moving to Drighlington, but I might double check with Jobcentre plus/DWP, because I'm unsure if they use the same rules as councils, with regard to local authority areas, and borders i.e Leeds Bradford border, and veering into a BD postcode but having Leeds council as the local authority

Thanks

Hi Mike D

If you move within the same Local Authority and claiming housing benefit, then there will be no change, you only need to report to your LA a 'change of circumstances', you would also need to inform the DWP of a change of address.

If you were in receipt of CB ESA and no other means tested benefits such as HB and moved LA areas then there would be no change in your CB ESA. If you are in receipt of IR ESA and moved LA areas then your IR ESA would stop and you would have to apply for UC along with a housing element to cover your rent.

One way of checking who your Local Authority is, is to check who you would pay your council tax to.

Note: Different LA areas can use the same Jobcentre-Plus centres, it is the LA area you need to check.
