Hello there I wondered if you had got to the bottom of this PDA? I am currently on Income Based ESA. My elderly mother is increasingly frail and may not have much longer to live. I will inherit the house when she dies. I know that I will then move on to contributory ESA. I am wondering what to do with the house and was considering letting it. My initial investigation via a charity welfare benefit line was similar to your initial thoughts they said;

"Receipt of rental income from a property the claimant does not live in would not usually be considered as 'work'. It would be income derived from a capital asset. Neither the income nor the capital should affect entitlement to contributory ESA (CESA)

However they did say that they were not legal experts. I was surprised and shocked to see your post regarding the DWP communication with you suggesting that rental of one property was considered to be work.

I am confused about this. I am not well enough to go through all of the DWP guidelines - I tried and couldn't understand it at all!

Please could you let me know what the outcome was. If you have references to where you found your information please could you let me know what they are .... I think some information is in Chapter 51 but I can not find it.

In answer to your question, the moderator who answered that specific post has retired after 10 years of service and had specialist knowledge in that field. I would advise you to seek help from a specialist welfare rights unit in your area.

If you are not sure where they are, try a google search for welfare rights organisation putting in your post code.
