P.s to PIP telelepne Appeal hearin was created by Quizzical
Hi.
I was asking on the forum if the panel or DWP member will ask my daughter questions at my hearing (she will be with me for moral support).
However, I forgot to mention that in my Application/M.R and appeal papers that my daughter and partner, encourage and support me in some of the descriptor categories.
So, because of that and the fact she will be there with me, will they question her.
Just want us to be prepared.

Hi Quizzical

We can't say for sure what will happen at any panel because it is up to the tribunal chairman. The panel generally want to hear from claimants only, but I can't say categorically they won't ask anything of any person on the call. Each case is different. That's the best we can tell you.

Hi Quizzical

They may ask your daughter as to what support she gives you on a regular basis and why. Remember it has to fit in with the PIP criteria.

I have been to many Tribunals and nearly always the panel will only talk to the claimant, the claimant's support worker is very rarely asked anything, sometimes they are asked to clarify an answer if the claimant is struggling. If there is a DWP member there then they may also ask the claimant some questions but quite often they usually pass when asked by the panel if they want to ask the claimant anything.

What your daughter needs to do before the Tribunal is to write down what help she provides for you and why, does she help you to get dress, is this because of arthritus or because you cannot move or bend your arms/hands. remember any help you get from your daughter needs to fit with the PIP criteria so follow our guides. if you say your daughter does the housework or shopping then you will not sore any points, PIP is based on personal help.
