1. Given the above, as his appointee, am I best placed to answer the questions, the appointeeship states: You are authorised to exercise on behalf of the person named...any rights they may have under social security legislation.
2.Do I need to notify CHADA of this prior to the appt?
3.Do I need to get a Doctors letter to support this and email to CHADA?
4.In the event of an appeal will he still receive his ESA basic reduced allowance?
5.Can I request for the assessment to be recorded.

Hi Slegne

The first question I would ask ... is the DWP aware that you are his appointee? www.gov.uk/become-appointee-for-someone-claiming-benefits, if they are then:

Q1): Yes, you are best placed to answer the questions, but you do not have a right to attend an assessment without your son being present but that does not mean that the Assessment Provider will not accept you doing so.
Q2): Yes, I would notify CHADA prior to the appointment.
Q3): If you are able to get a supporting letter from your doctor, then do so, when contacting CHADA if you have a letter from your doctor then let them know, they may want to see it.
Q4): Yes, in the event of an appeal he will still get standard ESA.
Q5): This is a bit tricky as we have received mixed messages from forum members.

You can legally record a telephone call without informing the other party providing the recording is being made for your personal use. In fact, do not tell the assessor that they are being recorded as they will likely terminate the assessment.

If you are using a smartphone then there are apps that will do this for you.

If you are using a landline and can put the call on speakerphone then you can record it using either a smartphone or some other recording device,

If it's a landline but you cannot put it on speakerphone then you will need a special microphone that attaches to the earpiece.

Appointee- Its a telephone assessment, and my son will be present, but has problems handling these questions as outlined previously. Is that ok as appointee (they are aware). to answer questions.
Recording- what I meant here, can I ask for formally recorded assessment by them, as with PIP?
