Hi Everyone
I would appreciate advice rather urgently !!
I receive ESA and was reassessed had to go to appeal at the same time I was appealing for PIP .. I’ve been put back in the support group were I had been for a few years and I get the disability premium benefit and recently won a PIP appeal after almost 2 yrs after it was removed due to the assessment being flawed by blatant lies.
Anyway my Dad moved to Spain a few years ago and regularly comes back and stays with me normally for a couple of weeks but due to Coronavirus and him being poorly he can’t go back to Spain yet.
He’s 86yrs old , had a heart attack 12 months ago which he’s recovered from but getting very frail.
He has gets a state pension but also receives a private one which isn’t much but takes him over the threshold for the government one that entitles you to everything free.
His savings were depleted when he had to pay for my Mums care fees as she had vascular dementia and Alzheimers before passing away 4yrs ago.
We don’t know if or when he’ll be able to return to Spain due to Covid ...
I receive 25% discount for living alone regarding council tax and he doesn’t actually live with me ... he’s staying with me temporarily... I am still in financial difficulties due to paying back money I lent when my benefits stopped and need advice on the consequences of my own benefits being affected when I inform the council tax etc that my Dads staying with me as I’m unsure if I will also loose my disability premium again and how long it’ll take to reinstate everything when he leaves ???

Hi Janet
Before you do anything, see if you can find a specialist benefits advisor in your area, because this is not our area of expertise and these are not normal circumstances. My answer would be that he is only 'staying with you,' and so it should not affect your benefit, but I can't find any advice on this and I think you should check with someone who knows what is happening in the current circumstances. I am sure you are not alone in this. Sorry I could not be more helpful.

Hi Janet, sorry to hear of your troubles. It is harsh you had to borrow to survive when your benefits stopped -they don't even pay back with interest when you do win. You could try 'CAP' for debt help, they are very good I'm told . They are a charity unlike profit-making insolvency sharks.

Our circumstances are a bit different as my mum is the tenant of a one bedroom sheltered accommodation. I gave up my council flat in a utter hell hole due to noise issues and increasing mental health problems and have been living with my mum for past two and half years. Council dragging their feet and not doing nothing really to help.
My mum loses about £15 per week from her housing benefit due to non dependent deductions. That’s the minimum based on being on benefits. If income goes above certain thresholds then the deduction goes up.
But if he has accommodation elsewhere then he is more of a guest than anything else. As I have no other accommodation the council are treating me as living here.
My mum has lost her 25% discount as I don’t see it on the bill. It says CTS Pension Age along with about 60% reduction.
It might be worth speaking to council to check as you don’t want to build up an overpayment.

Hi Janet
As your dad is living with you on a temporary basis and is not living with you as his sole or main residence he should be disregarded in assessing your council tax liability and so you should still get your for your 25% reduction and he shouldn't affect your other benefits as long as you can show this is the case. Regarding this and your other issues with money you owe you might want to call your local Citizens Advice to talk this through.
