Hi, hopefully someone can help.

I’ve had my pip claim rejected and the grounds for this is due to them saying that as I can care for my daughter I can care for myself.
My mental health psychiatrist called unexpectedly and asked me a lot of questions as to how I look after my daughter like do I bathe her. I told them that I run a bath for her she steps in and I supervise her. However if she has a bath I am exhausted by this and I need to take time to recover.

They also have said that as I can prepare a meal for her I can eat myself. However I have bulimia and the overwhelming emotional distress I have with eating means I don’t eat at all or I end up eating a packet of biscuits because I lack motivation to eat something substantial.

I feel I was treated unfairly as the application was how my disability affects me not how am I able to care adequately for my daughter. My mum helps approximately 4-5 days a week so I can function to a basic level.

Is this standard or fair practice as I am appealing this.

Hi Hvgiffard

I'm sorry this has happened to you. I can understand why you felt the questions were unfair, but any claimant for PIP who cares for a child or an adult will be asked those sort of questions. Assessors offer opinions and make assumptions and you are free to argue against them.

If you haven't already, you need to get a copy of the detailed assessment report so you can understand why you were turned down. You also need to look back at your application. You said your mum helps 4 or 5 days a week. Did you make this clear in the report and did you say exactly what she does for your daughter?

If you want to you can put in for a mandatory reconsideration look at our Guide to PiP Appeals which also has the information on MRs.

Hi Hvgiffard,

You might also want to consider having a conversation with your mental health psychiatrist and explain how his/her report has been interpreted. They then might be willing to write a supporting letter for you to include with your MR submission saying that the assessor had made unreasonable extrapolations. Something to think about.

thank you for your advice, I have paid for the guides to do the appeal now and will call asking for a detailed assessment report.

I will also call the CMHT and let them know. I just felt it was underhand that they use my ability to care for my daughter when my ex has threatened to take her before and it was documented that this is a cause of my anxiety to be heightened let alone the other conditions.

A supporting letter from your CMHT could make your path to success much smoother.
