Hello I need some advice please, My husband has been on SSP since Sept 2020 at first signed off with depression, sadly we have had confirmation he's got cancer and because of treatment he will be embarking on, working won't be an option, I am also disabled ESA CB support + enhanced PIP for both. My question is we have been paying full council tax and housing benefits out of our money, but know at some point his SSP will come to an end, I assume after 26 weeks? Does he have to wait to hear from his company his SSP has ended and then we have to claim ESA for him? or do we make a claim now as I know appliactions are taking a while, I'm on old legacy benefits so don't know how the system has changed with UC and making a joint claim, any advice appreciated.

Hi HelenaC

Your husband can claim SSP for 28 weeks, after which he can then claim NS ESA depending on his NI contributions.

You cannot get New Style ESA if you’re getting Statutory Sick Pay (SSP) from an employer. You can apply for New Style ESA up to 3 months before your SSP ends.

Council Tax and Housing Benefits are both means tested benefits, therefore your house hold income would be taken into account. Most new claimants will not be able to claim for HB even if you get a SDP, rules change today, you now have to apply for UC and the Housing element unless you live in a exempt accommodation.
