Hi Hil,

It is the request to FtT for their statement of reasons which must be made within a month of the Tribunal’s decision, not the request to appeal. The SoR can take ages to arrive, once again they have no time limits. Nice you have received it you then have a month to make your request to appeal to the Upper Tribunal.

Oh this is good news thank you.
So there is a one month period from date of First Tier Tribunal decision, for claimant to request SoR and RoP from First Tier Tribunal.
Once the SoR and RoP have been received there is a further one month period for claimant to make request to appeal at Upper Tribunal.
I hope I have this right?

Spot on Hil.

My only comment at this stage is to prepare for a long wait. As I said the 1 month rule does not apply to the Tribunal Service.

You are clearly thinking of possibly taking this to the Upper Tribunal. You might wish to use the time to find someone who can help you with the process - subject to financially qualifying legal aid is available for this. The practicalities of finding someone will depend on where you live. Many of the welfare agencies have people who can support you - but it might take a number of phone calls to track one down. So this is good use of the time whilst you are waiting .

Alternatively you can do it all yourself. The Upper Tribunal is supposed to be accessible to everyone, but it is for exploration of the interpretation of the law rather than whether or not you are entitled to an award under the law. If this is something you wish to do yourself, or have no choice but to do, use the time to start reading and re-reading the legislation and UT judgements which may have some parallels to yours.
