Hi there, I've been asked to help with a case where the person was turned down for AA and the decision was delivered by phone rather than letter (on the grounds that they can wash and dress themselves) Am I correct in thinking this is highly unusual, or do they deliver decisions verbally these days? If there was no letter how does this affect challenging the decision please?
Also, how long do you have to leave it between being turned down for AA and starting a brand new claim for it (rather than going for a Mandatory Reconsideration)

I know a gentleman who was rung up on Saturday to be told the outcome of his PIP MR. I have to admit that I suspected a scam it seemed so unlikely, but it was true, and he is now in receipt of his money. Unfortunately he is not a gentleman who always remembers clearly when it comes to paperwork, but he thinks he has had a letter.
If I was going to consider challenging the decision I would ask for the Assessor's Report. This give you a better idea of why they think what they do.
As far as I know there is no minimum time before putting in a fresh claim, but the problem you will have is showing that the person's condition has changed since the previous assessment. If you just fire off a very similiar application with the same evidence they will compare it with the previous one and I am sure will give you the same answer.
If of course the person you are helping now needs more help then have another go.

You are better going for a MR, remember that applying for AA is all about personal care needs, I have helped quite a few claimants apply for AA, some get turned down initially but I have always applied for a MR and been successful. You do need to ask for a copy of the decision makers decision which will tell you how they made their decision before applying for a MR.
