pip appeal was created by Foz
dla to pip was changed and was awarded pip but took the mobilty element from my mother who has now hit pension age i did mr but was refused also refused at an appeal so after a while put in for coc which was refused for the mobility and higer care only at that point i was told she is not elegible for mobility as she is now pension age and is not elegible for this ,what a waist of time all this was and putting a pensioner through all this is absolutly discusting .so now i am going to a tribuneral again as she is on low care and would like to try for high care as now after nearly 2 years been told she is not elegible for mobility again due to her age .
so any help or adive would be great and maybe a sample cover letter to write for the appeal.

Hi Foz

The relevant age is 65 or State Retirement Age, whichever is the higher.

You cannot be awarded the Mobility as a new or an increased award after you reach the relevant age with the exception of the initial transfer from DLA to PIP where the age restriction is suspended.

If you have a Mobility award before the relevant age then you can continue to receive it after as long as you continue to meet the criteria.

MRs and Appeals remake the Decision being challenged and apply from the same date so if the MR or appeal takes you past the relevant date you can still receive the Mobility Component if awarded as long as the original date was before.

There is no low care component with PIP, you either have standard or enhanced components, low care component is associated with DLA.

Have a look at our PIP Claim guide for a better understanding of the criteria your mother will need to meet.
