Final date for Contribution based ESA was created by Chrislu
Hi , My daughter has had a letter informing her that her contribution based ESA finishes on 8/9/21.Does she have to do anything just now?
She is awaiting surgery and has been told by the surgeon she will be unable to work for the 18months following these operations. Will she go onto income related ESA automatically or is there any way she could go onto the support group ESA

Welcome to Benefits and Work.

Am I right in assuming that your daughter was placed into the work related activity group? If so, this means that she can only claim benefit for 1 year, as this is the time set by law.

I note that your daughter needs surgery, and won't be able to work for 18mths. Is this just the kind of work she normally does, or is this all work, so effectively this is complete rest at home?

At present there doesn't seem to be anything to do in respect of ESAcb, of course hopefully your daughter will soon get her surgery done. If this before 8/09/21, then notify DWP and inform them. If your daughter can not do work or any work related activity she should fall within the support group, and this is not time barred.

I am however a little confused. I am assuming that your daughter was only placed onto ESAcb last September. Why was this just cb ESA? Does your daughter have under £6,000 savings/investments, which is totally ignored, or alternatively does she have no more than £16,000 savings etc which will be taken into account,and will reduce the amount of benefit pro rata? Does she have any other income -excluding PIP or DLA. If either of the savings scenarios apply, and there is no other income then she should be entitled to receive means tested ESA, (or the equivalent via UC.)

However, if she has any income or savings above £6000 then this would reduce her ESA means tested amount. If the cb amount was more, then she would receive the (higher) cb amount.

I think it would be a really good idea to contact a local advice centre such as CAB, and get someone to do a full check on your daughter's benefits.

In addition, if your daughter does not already claim PIP, she may be eligible for this, depending on the nature of her illness/disability. For more information have a look at the members guides - the PIP one is here;
