Hello all, I've had quite a bad experience with dealing with PIP over the last few years and was hoping for any advice on how to proceed? About 4 years ago my PIP was dropped from higher to middle rate (both mobility and daily living), I asked for a re decision and my money was completely stopped with only a weeks warning! I live alone and suffer with anxiety, fibromyalgia as well as recently being diagnosed with severe COPD. I appealed and after a year I received a call offering me to go back to middle rate, I'll be honest I was so happy to be going up and I was so confused I just agreed to whatever they said. Then last March I started to get unwell and for the last 12 months I've been in hospital 3 times with pneumonia as well as being diagnosed severe COPD. I asked for a reassessment and in January this year I was told I'd was remaining middle rate for both elements! This is despite many dr letters, proof etc! Again I've asked for a redecision and my daughter and I have used your guides but the waiting is making me so anxious, is there anything I can do but wait? It doesn't seem fair my telephone assessor seems to have twisted or changed what I said?

I am sorry to here that your PIP journey has not been easy. Do I assume correctly that you received a decision of standard daily living and mobility?
It seems that you have done everything correctly so far. I am glad that you found the guides useful. Hopefully you will soon receive your latest decision. If you haven't already, please phone DWP and ask for a copy of your assessment report (P4A). You are entitled to this, and if you need to take the case to a tribunal this will help you to see why DWP have come to their decision. Whilst you are on thephone, you could also ask how long the decision will take.
It is entirely possible that DWP will revise their decision and increase your award. If not, then you can appeal to the tribunalIf you feel that you should appeal, have another look at the guides, be absolutely sure how many points you should get. Remember that even though your condition has become worse and things are harder, you may not get extra points, particularly if you have the maximum points appropriate for each activity. Nevertheless,there is a very good chance of success at the tribunal. However, be aware that the tribunal are entitled to look at your whole award, very occasionally they decide to reduce the award - so there is a small risk. You may wish to seek advice from a benefits advisor, from a local advice centre. The advisor will be able to go through your case, and may be able to help you lodge an appeal and represent you.
