Hi
I am getting ESA SG and PIP. Have been sofa surfing at my mums one bedroom flat for a couple of years. There is a possibility of a two bedroom but I don’t know if the council would insist on a joint tenancy.
Now I realise I would not get SDP in this situation but also I would not be able to claim housing benefit unless I claimed UC.
Now I’m due to be on ESA until about Spring 2022 so what would happen if I had to apply for UC? Would they honour my current claim by putting me in the UC equivalent of SG or would it trigger an assessment?
It may be easier for my mum to be the tenant and she gets whatever housing benefit she is entitled to and we split the rent unofficially between us.

We cannot give you any advice as we do not have all your relevant information such as how old your mother is, what benefits she is in receipt of.
You need to get advice from a local welfare rights worker who can take all your circunstances into account. We do not not give advice as we do not have all your relevant information and any advice that we might give could be misleading therefore we can only give information in a general format.

In regards to housing enquiry, you need to contact Shelter who will be able to give you help and assistance; england.shelter.org.uk/housing_advice. The council cannot insist on a joint tenancy, these are the questions you need to ask Shelter as they can explain the pro's and con's of becoming a joint tenant and the effects it would have on your benefits as well as your mothers.
