Hi

I’m looking for some advice please in relation to a possible UC claim for my disabled daughter aged 22 . She has a severe learning disability and epilepsy requiring 24 hour care .
She already receives ESA. In the support group and high rate PIP. Our local council charge her a large amount towards her care package. I have disputed this amount and complained as they do not take into consideration any housing costs she has when calculating her financial contribution she has to pay. They advised me to claim for the housing element of UC and that I should give her a tenancy agreement . When I spoke to citizens advice they advised that you can not claim this aspect if you live with family member. Has anyone else been in this situation ? most of her ESA is going on care costs, thanks in advance x

Your question is outside the remit of this forum, we do not give advice on housing or care packages, you could try Shelter england.shelter.org.uk/housing_advice and MAS www.moneyadviceservice.org.uk/en/article...ority-over-your-care

Unless your daughter's name is on the tenancy agreement, then she will not receive any housing element, the Citizen Advice is correct with what they told you. If your daughter claimed UC then her ESA claim would cease.

Thanks Gary . My question wasn’t about the care package , i added that in to give a background of the situation . It’s the housing element of UC that it relates too . Thanks for this links
