advice for friend with kidney failure and heart co was created by edt7
i was wondering if you could give me some advice for a dear friend, he has never claimed anything before, and has difficulties using pc, hence me asking
anyway he had a triple by-pass around 3 - 4 years, with a further heart attack after that, this has effected his kidneys, and he is now on the live donor list, as well as about to start home dialysis,
i have advised him to claim PIP, but was wondering if he could also claim ESA, and partner claim carer's, (assuming he gets PIP), at the moment he is still 'employed' but of course not working just now, and his wife also work, he lives in the Essex/London area, so not sure if maybe universal credit might effect him
any advice that you could give me to help would be welcome as i am unable to help any other way, have tried, and he has always been there when i needed support,
many thanks in advance

Hi emma
Sorry to hear about your friends predicament. we do have some excellant guides to help with both PIP and NS ESA.
As a new claimant your friend will not be able to claim any legacy benefits, depending on his NI contributions he may be able to claim NS ESA which is the same as CB ESA in all but name.
New Style ESA is a Contribution Based benefit and is not means tested with the exception of pension income which can reduce the amount that they receive.
The Income Related benefit that goes with NS ESA is Universal Credit.
NS ESA will end after 365 days unless you friend is placed in the LCWRA/Support Group
Providing your friend has at least 50 weeks of NI Contributions in both of the Tax Years 2017-2018 and 2018-2019 then they can make a claim for New Style ESA, this is a Contribution Based benefit so their household income, with the exception of any pension income they receive, is disregarded as are their assets and savings.
www.gov.uk/employment-support-allowance/how-to-claim
If your friend is awarded Limited Capability for Work then the NE ESA is only payable for a year, if they receive Limited Capability for Work Related Activity then it is payable for as long as they meet the criteria.
Our UC and ESA claim guide explains the criteria that they will need to meet.
www.benefitsandwork.co.uk/help-for-claimants/esa1
PIP is not awarded because of the condition but rather the limitations that result and prevent a claimant from completing a range of everyday activities. Have a look at our PIP Claim guide for a better understanding of the criteria your friend will need to meet.
www.benefitsandwork.co.uk/help-for-claimants/pip
Read about the reliability element in the guide - if your friend cannot do something:
• Safely – in a fashion that is unlikely to cause harm to themselves or to another person.
• To a necessary and acceptable standard – given the nature of the activity.
• Repeatedly – as often as is reasonably required.
• In a reasonable time period – no more than twice as long as a person without a physical or mental health condition would take to carry out the activity.
then they should not be considered able to do the activity.
If you have any further questions, then please return to the forum.

Hi Emma and like others, sorry to hear of your dear friend's poor health. Some of this is in the guides, just practical things if you yourself are new to all this....
Kit yourself out with some sort of filing system to keep control of all the paperwork.
Any document whatsoever that you attach with a form including extra pages of answers, be sure to send only photocopies and put his name and NI No. on the top of every page. Try to number them as eg, Page 2 of 15 to discourage the contract scanning service from missing any pages.
Always use a signed-for postal service and keep tracking record.
Any phone-calls, note down date, time, name of person [they only give first names] and what was said. Put the notes in your file. If it's important expect to write to confirm yourself.
There's lots about the assessments in the guide, but don't forget two days later to call for the assessment report, [called a PA4 but you don't need to say the number unless they are acting dumb..]. You should always request this ASAP.
All these things are out of many people's long experience of DWP, tried and tested. He is lucky to have your help, and everyone here will be supporting you.
best, Denby
