It has been a wee while waiting for decisions to be made regarding universal credit, new style ESA and PIP, a mandatory reconsideration for PIP, but I have finally been awarded with all three; UC in the LCWRA group, and nsESA (support group that will continue beyond the year entitlement). I have been awarded standard rate daily living and enhanced mobility for PIP.
I had to do a mandatory reconsideration, and at the same time, I did a complaint to IAS because the report seemed to be about someone else!!
IAS have responded to say that the report did not meet quality standards but does not explain why some of the statements were false (or a "misunderstanding").
A couple of "misunderstandings" are expected, but practically the whole statement is about someone who "looks after her mother, runs a business, does the housework, laundry, shopping, walking, going out every week socially, using FB/Twitter/Instagram for business and personal, looking after pets, going to see clients, telephoning clients, etc., etc."!!
Even though I have actually got an award of PIP, it is not on the back of their HP's report, but on my own Mandatory Reconsideration letter and supporting documents and statements from family.
I just wanted to know if I could take it further with IAS? I feel they should be held responsible for statements that they make that's all!

Many congratulations on the awards and well done. It must have been quite daunting doing all three at the same time, you can now relax and maybe get ready for the next fight.
In answer to taking it further, there was an article in our newsletter dated 10th March 2021 about a claimant called Rebecca.
Rebecca was so angry at the treatment she had received from Atos that she sued them through the County Court for ‘mental distress, anxiety and hardship’. Atos made no attempt to defend the claim.
The County Court found in Rebecca’s favour and awarded her compensation of £2,500.
When Atos failed to pay up, Rebecca arranged for enforcement officers to visit their offices in London, resulting in an extra £2,000 in costs to the company, which finally had to pay up.
We know we will be speaking for many claimants when we say that we have nothing but admiration for Rebecca’s courage and her refusal to be bullied or ignored, even when coping with so many health conditions. www.benefitsandwork.co.uk/news/4350-clai...en-they-don-t-pay-up

Hi, While I agree you're totally right to take time to cool off before deciding, if you DO tackle them, the more who succeed against assessment abuse of claimants, perhaps it will deter them from doing it so much. And it adds to the body of legal precedent, which is vital for people who follow being able to get legal help on the basis of good chance of success. All this would help the victims less able to pursue them.
