Hi, I have already previously sent a question regarding rules of SDP benefit, a SDP award is being reviewed for myself, backdating for the year 2016, I was receiving pip standard care component than, and my son was living with me, and receiving esa and pip, high rate care. Would I have been entitled to apply for sdp backdate benefit in 2016 if I was receiving pip at the standard care rate. Thank you.

The answer is yes, over the last few years I have done quite a few claims for SDP that I have come across when checking clients entitlements, all of the claims have been backdated to the date they qualified which can go back many years.

If you are in receipt of HB and not getting the full amount, this will also be backdated and a SDP premium added from the same date as your ESA.

With regards to the question, if members are in receipt of a case package from social services, they might need to be aware that the SDP will be taken into account.

I got a lump sum of the SDP award a year or so ago for my son, dating back to when he went into independent living.
He's in receipt of a care package from social services and they took all the lump sum as well as the ongoing amount in extra contributions to his care package.

The recent Norfolk case means that this can be challenged, and there is a charity which is helping disabled people and their families to challenge unlawful charges for care.
