Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi lyn
Before answering your question, does your friend receive CB ESA or IR ESA.
Yes, DWP would know about inheritance via probate, they also know if someone has a pension(s) (no matter how much) or savings.

Hi JJ,
thank you for your reply. I hope that it might be possible to use the money towards purchase of a house. There won't be enough to buy a house outright, so I'll have to work it out.
Many thanks, AC

Hi Catherine,
thank you very much for your reply.
Unfortunately, I think it's probably too late to chance what happens with my inheritance now. Actually, it's possible what you wrote would apply to me because I'm struggling physically and mentally to process all the information and sort out what I need in order to fill in all the appropriate DWP forms and so on. It's been really hard trying to find any advice or get support and my health problems make it difficult to process everything. I did try our local Citizen's Advice but they were (understandably) overwhelmed because of the pandemic.
Thank you again for your reply, I really appreciate it.
Best wishes, AC

Hi lyn
As it is IR ESA then they may be affected even if they do not accept the inheritance, the DWP may class it as 'notional capital' .
Your friend needs to seek advice from your local welfare rights organisation, this is not an area we deal with on the forum, although we can try and point you in a direction from personal experience like Catherine.
You can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk

Hi Gary,
thank you for your replies so far. I'm sorry to ask more questions...
You said that I would not need permission from the DWP to purchase a house. So does that mean I would just go ahead and buy the house, then re-apply for ESA? Presumably the DWP could refuse on the grounds of asset deprivation?
I read somewhere that an ESA claim can be kept open for National Insurance payments only, but it seems that's not correct?
Sorry again for asking so many questions and thank you for your help.
