Dear Moderators.
I have just read your latest news article about the misleading letters/LEAP review.
I was transferred from DLA to PIP in November 2017, I was awarded PIP 11 points for daily living and the 4 points for mobility.
I believe that I was affected by this change in PIP law.
I received the letter PIP Changes in PIP law "we have looked again at your PIP and it has not changed". I received this letter in October 2019.
I did not know what to do as I did not understand it as in the letter it also mentions RJ v DWP, relating to carrying out activities safely.
The letter also claims I had only one month to ask the DWP to reconsider, so I am well out of time as I said above I received this letter in October 2019.
At my last PIP review I was awarded enhanced for both parts.
I was writing to ask for any advice please.

Hi Taylor
You can go back to them and ask them to relook at your claim. I can't tell you what they will say to this request. The fact that you received enhanced for mobility at the last review, won't automatically impact on the previous decision.

Hi, Thanks for your reply Bis.
When you say ask them to re look at my claim, do you mean my previous years.
I thought that I only had one month to ask them to reconsider ? From the date of the letter that I received in October 2019 ?
Also will asking have an impact on my current award ?
I realize that my current award will have no impact on my previous award, but I may use the fact that I do have enhanced now.
As I would argue that I have always sent in the same evidence for the last 30 years, I am curious as to why decision makers come to different decisions when I have sent in the same evidence and information on the forms that I have completed.
Could I ask if there are any plans to introduce a sample letter for members to request to ask for previous awards to be looked at again with regards to the new laws ?

You said that in 2017 you were only awarded 4 points for mobility. In 2019 you received a letter saying there was no change and a month to respond.
You also said that you believe your case was impacted in the change of the law in 2016. Now if you believe that decision was still wrong you can try and challenge it if you wish. Yes, it is a late response (and it may be too late) but as reported in our newsletter these letters made it difficult to understand the decisions. However, the DWP has yet to agree with this point.
So you could try and put in a late response, or you could wait for more information, or you could do nothing and accept what you have already been told. I can't tell you what you should do and I have no idea whether they will say you've already had a judgement or whether they will be prepared to look again.
Asking questions has no impact on your current award.
Because you have an enhanced award now will not necessarily have any impact on any previous decision.
Even though you have been sending the same information for 30 years, the criteria for benefits have changed every time one has been replaced which as far as the DWP is concerned nullifies many past comparisons.
As far as I know there isn't a plan to produce a standard template - but that might change in the future.

Thank you so much for clarifying that for me.
I shall wait and see what happens with regards to the new laws.
I will just carry on as I have done in the past , sending in what is requested of me to do so, updated information, as always of course.
