Severe disability premium/care of address question

Hello,

I’d be very grateful if someone could help me with the following question, as I can’t find an answer or similar situation anywhere else. I’m long-term disabled and in the support group for ESA, and higher mobility and care for PIP. When I went through the process of applying for benefits, I still lived with my parents, but about 3 years ago I was able to move out to a flat nearby (as I still need to be close to my parents for them to care for me). I never changed my correspondence address with the DWP, as my condition hadn’t changed, and the communal mail at my flat’s building wasn’t very secure, so I thought it was safest and easiest for mail to keep coming to my parents’ address.

Quite a while ago I received a letter saying I may be entitled to the Severe Disability premium, with a form to fill in and send back. I realised I fulfilled the criteria for it, but never did anything about it, as I’m always quite terrified of triggering any reviewal of benefits - it was such a stressful and exhausting process applying for them, and not one I want to repeat. My health was bad and I was struggling, and I was managing OK financially on what I was already receiving at the time, so decided I couldn’t cope with the extra stress. Recently though I learnt that if I applied for this benefit, it might be an easier process when I get switched to Universal Credit, which would be a relief. I am also in a position financially now where the extra money would be very helpful.

I realise I am entitled to it as I do live alone, but I’m not sure how the claim will be processed if my registered address is still my parents’. Therefore I’m not sure whether to - (the following seemed to be the easiest way to lay this out as there were so many permutations!)

A) just mail the form back confirming I live alone, and see what transpires

B) mail the form back confirming I live alone, and enclosing a covering letter explaining the circumstances

C) send a separate letter first explaining the circumstances and asking for advice on how I should proceed. However, given my previous interactions with the DWP, I’m not confident I would get a clear answer, hence why I wanted to post here first!

D) write to inform them of the change of address but ask that my parents’ address continues to be used as a care of address; and then apply for the severe disability premium afterwards

Hi Raindrop,
As you are on ESA, (assuming this is means tested) and receive at least standard rate daily living PIP and live alone you can receive SDP. However additionally there must be no one who cares for you and claims Carer’s Allowance for looking after you. If these all apply you can get SDP.
Do you claim Housing Benefit or Council Tax Reduction. Presumably if you do then at least the Local Authority will have your correct address. Maybe also your parents help you with letters etc?

Firstly, if you apply for UC you may not get the same amount if money. It is likely you would have to have another assessment, and SDP is no longer paid under UC. There is a transitional protection (extra money to compensate) for those already on ESA and SDP. Not sure if you would get this since you are not already being paid SDP.
Remember that UC is n ormally managed digitally, so you would need to access a computer and be able to comply with requests etc done this way.

Is your current address in the same local authority area as your parents' house? If you 'appear' to be moving into a different authority area this might trigger a UC claim, IF you want to claim Housing Benefit, and you have previously provided the wrong address for this. If you have claimed Housing benefit / CTax Reduction at the wrong address, this is something you need to sort immediately, as there might have been an overpayment.

If you fulfil all the criteria above, for SDP. I suggest that you fill out the form, using your actual address if required on the form. Attach a covering letter explaining your health, anxiety, stress etc, and that the mail is insecure at your home. If you parents do help with your post, you can say this to as it is then more helpful for them to have your post . If you have been receiving Housing benefit/Ctax Reduction for your home then say this. You might wish to include a copy if any tenancy agreement to show when your tenancy started. It may be possible to have a backdated claim to the start of the tenancy.
Keep a copy of what you send in including the form and letter. You can if you wish send the whole thing as recorded delivery.

Aside from being able to receive SDP, I think it is important that you are clear with DWP and local authority where you live. If you don't I think this might affect benefit payments. DWP might wonder that you are being fraudulent, but even if not they might want to investigate you, and it might lead them stopping your benefits.
Keep everything simple, and don't put yourself into a position that could have adverse consequences.
