Large change in circumstances after assessment. was created by Rachel_Sagar
Hi, Newbie here. My mobility has been gradually getting worse over the years so that I couldn't walk unaided (used disability 4 wheel walk and rest trolley) and even with that, I'd be in severe pain after 2-3 mins and couldn't stand for more than 2. Despite that, my Mobility (lower level) was cut. I'd been told it was part of Fibro, but now am certain it's spinal compression and am waiting for Orthopedics appointment. Previous home visits had awarded me lower level for both Mobilit and Personal Care.
I recently had a PIP phone assessment that took away my Mobility payments. Shortly before receiving it, I woke up one day and couldn't move. There was nothing I'd done to cause this, unless it was the AZ vaccine, but that was nearly 3 weeks before. Nearly 6 weeks on, not much has changed and I can only move around my flat with difficulty using 2 walking sticks or a Zimmer frame. I can't get down the stairs safely by myself, have had to buy a wheelchair and have only been able to go out once (in friend's car with much assistance) in over a month. A Rehabilitation Team provided me with cleaners, carer and a Support Worker. I will very soon be passed over to Adult Social Care.who will do a further assessment.
My question is whether I should go for a Mandatory Reconsideration, which will almost certainly lead to going to Tribunal - I'm not at all intimidated by the idea - or whether to tell the DWP there's been a change of circumstances and have a new review, which will take probably 6 months to get a phone assessment and report. I'm guessing waiting for a Tribunal Date will take as long. I don't know which will be the best option. I intend to appeal on both Mobility and Personal Care. I now need help with bathing, cleaning, dressing and mobility. I live alone and have no family at all. I also suffer from agoraphobia, depression dyscalculia and aspects of Asperger's, such as poor executive function, disorganisation and outspokenness.

Hi R
Welcome to the forum, you might want to have a look at the following FAQ which explains where everything is
Welcome to Benefits and Work
In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ
My full name is showing, how can I stop it?
There are two separate issues here.
If you put in for a mandatory reconsideration - it will only consider issues before and up to your assessment. It will not look at issues that have arisen with your mobility after that point. So if you think you should have been awarded more for your mobility at the time of your assessment - argue the point - but don't try and add any more recent things.
The deterioration of your mobility could be dealt with through a change of circumstances. I wouldn't put in for that, until you have confirmation of the diagnosis.
You can put in for an MR and still put in for a change of circumstances at the same time.
I can't tell you what to do here, you can only decide what you think is best and go for it.
