PIP Tribunal Stage - So Many Mistakes Made by them was created by Alice-Anne
Hi,
MY PIP claim is now at the Tribunal Stage and I am about to write an accompanying statement as I have been advised to by my representative.
As has happened to a lot of people, my claim has been dealt with appallingly by the DWP and HM Courts and Tribunals; and they are both currently under investigation by their governing bodies for a series of serious of mistakes they have both made, not least sending my entire bundle of information to a complete stranger and sending their bundle to me and the DWP appearing to lie about the status of my original application and sending out letters to me regarding it. The DWP letters may have been sent to the wrong person as well, we're waiting to hear back from the investigation team.
I'm not whining, these are definite mistakes that have been made and I have been substantially, financially compensated for what they did wrong.
What I wanted to ask advise on, is should i include this information in my statement? There were no provisions to my accepting the financial compensation offered and I did not have to sign any non disclosure documents.
I ask, because the disclosure of my information has caused my mental health to seriously deteriorate (I am claiming for mental health issues) and I am now struggling to leave the house due to agoraphobia and increased paranoia. However, I am aware that the Tribunal will only be looking at the period I am claiming for and not things that have happened after my initial claim.
I'm not being emotional or damning with my accompanying statement, I am sticking to the facts and how I fit the descriptors, but I really do feel that that the mistakes that have been made are relevant to my ongoing and declining mental health issues.
Any thoughts please?

I'm sorry that you have had such a horrendous time. Absolutely nightmarish. If I was in your position, I would mention it. You are right they are going to be looking at the time of your claim. However, you have to give an account of that time now, when you have been adversely affected by what came after. They need to know as this all relevant to how you fight your corner now.
The panel may choose to ignore it entirely, so you actually have nothing to lose by mentioning it.

Hi Alice-Anne,
I agree with with BIS.
I think you can go a bit further than just a mention. You don't say whether this is a first claim for any sort of disability benefit including ESA, DLA, Industrial Injuries Benefit etc, or whether you have already had one or more benefits previously.
Of the latter applies then you should include details of the relevant benefit/s.
DwP need to fully explain why any previous awards are different from the present one (or lack of one!)
I think it is legitimate to say that from the very start of this claim DWP has shown z complete lack of proper decision making process, and if you have had a previous award per above, this is now highlighted by the completely different decisions that have now been made.
Just write one succinct paragraph about this. Then, as you say, concentrate on the descriptors that apply, you can refer to the members guides for more details.
And yes, the tribunal will only want to know about the time of the decision. Strictly speaking it should concentrate on 3 months before and 9 months forward, if this is your first claim.

Thank you for replying.
This is my first claim for PIP. I haven't been on benefits before, I've just used the stiff upper lip method of coping with my mental health issues.
Unfortunately last year brought incredible loss for us ( as it has for so many people) and I just haven't been able to keep calm and carry on as usual.
DWP seem to have consistently lied about the status of my claim. Said they had contacted me when they hadn't, said they had sent out two letters then said they couldn't possibly have sent them out as they hadn't even processed/received the form or further evidence. Then said I hadn't ever contacted them, when I had a text confirming they had received my claim and further evidence. It's been awful.
This place is very helpful and I am very grateful for your help and advice.

Thank you for your kind words.
Unfortunately on this forum we hear a lot of bad practice from DWP as well as some good practices. You may want to keep a record of what has been happening, if you are unhappy then get in contact with your MP who may be able to expedite your claim.

Just wanted to ask another question and it's probably a weird one.
I went to school with my MP and I don't want to go through my personal information with someone I know, plus it might be a conflict of interest?
Who would I take it to if it wan't my own MP?
